Terms of Use

These terms are an agreement between you and JCOM LLC, a limited liability company registered in Wyoming, United States, with its address at 1309 Coffeen Avenue STE 1200, Sheridan, Wyoming 82801, United States ("we", "us"), for the Vocazap app. By installing or using the app you accept them. Apple's standard Licensed Application End User License Agreement also applies; where the two differ, these terms apply.

1. The app

Vocazap is a vocabulary game: you see English words and pick their meanings, in rounds, levels, reviews and a daily edition. It is a learning game and does not replace teaching, a dictionary or an exam course. If you are under the age at which you can accept these terms where you live, a parent or guardian must accept them for you.

2. Your progress

• Progress is stored on your device (see the Privacy Policy). It is lost if the app is deleted, unless it was saved in a backup of the device.
• Levels, streaks and scores reflect play in the app only.

3. Free version and ads

• Vocazap can be downloaded and played without paying. The free version includes Today's edition every day and the first level with as many rounds as you like.
• The free version shows short ads from Google AdMob between rounds, never during a question. How ads are chosen and how to change your choices is explained in the Privacy Policy.

4. Vocazap Unlimited

• Vocazap Unlimited is optional. It removes the ads and opens every level, the full word library and the review of missed words, plus word packs we add later. It is offered as a one-time purchase (paid once, yours for as long as the app is offered) or as an auto-renewing monthly subscription. Prices are shown in the app, in your local currency, before you buy.
• Purchases are made through your Apple Account and billed by Apple. The monthly subscription renews automatically each month unless it is cancelled at least 24 hours before the end of the current period; your account is charged for the renewal within the 24 hours before that. Manage or cancel it in the iPhone's Settings > [your name] > Subscriptions. Cancelling stops future renewals; Unlimited stays on until the end of the period you paid for.
• Refunds are handled by Apple under Apple's policies; we cannot issue refunds directly.
• To get Unlimited back on a new device or after reinstalling, tap "Restore purchases" in the app, using the same Apple Account.

5. Today's edition: fair play

• Every day all players get the same 10 words. Only your first play of the day counts for your score, the share of players you beat and your place in your country. You can play again, but replays are not scored.
• Please play it yourself. Don't use scripts, bots, automation, several installs or changed apps to send scores, and don't try to get around the limits of the scores server. We may ignore, correct or remove scores that are clearly not from normal play, and we may change how scores and places are worked out.
• Results are for fun. Percentages and places depend on who played that day and may be shown later if you play offline.

6. Words and definitions

Every word, definition and example sentence in Vocazap is written and checked by hand, and we do our best to keep them accurate and up to date. Words can have more than one meaning, and the app shows the meaning it teaches. If you spot a mistake, please report the word by email to [email protected] with the word and what looks wrong, and we will look at it.

7. Acceptable use

Don't reverse-engineer, resell or misuse the app, and don't use it to break any law. That's it.

8. Availability and changes

We work hard to keep the app reliable, but we can't promise it will be free of errors or available at all times. We may add, change or remove features, and may stop offering the app; if a paid feature is removed we will make reasonable efforts to inform you.

9. Disclaimer and limitation of liability

The app is provided "as is" without warranties of any kind, to the extent permitted by law. To the fullest extent permitted by law, JCOM LLC is not liable for indirect, incidental or consequential damages, or for lost progress or data arising from use of the app. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim. Nothing in these terms limits rights that consumer law gives you and that cannot be limited.

10. Governing law

These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. Any dispute arising from these terms or the app will be handled by the state or federal courts located in Sheridan County, Wyoming, and you consent to their jurisdiction. This does not affect mandatory consumer protections you have under the law of your country of residence. If you are a consumer in the European Union or the United Kingdom, you may also bring a claim in the courts of the country where you live.

11. Third-party beneficiary

Apple Inc. and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Apple has no obligation to provide maintenance or support for the app; if the app fails to conform to any applicable warranty you may notify Apple and Apple may refund the purchase price, but Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the app, including product liability, legal or regulatory compliance, and consumer protection or intellectual property claims.
